Liability Waiver

By signing this waiver, you acknowledge and agree to the terms below before participating in any tour, boat trip, or experience operated by Todochido Tours. Please read carefully.

1. 1

   Assumption of Risk

   You understand that participating in marine and outdoor activities, including private boat tours, snorkeling, swimming, beach excursions, fishing, jungle hikes, waterfall visits, and night tours, carries inherent risks such as drowning, sea sickness, sunburn, dehydration, slips and falls, contact with marine wildlife, sudden weather changes, equipment failure, and other physical or emotional harm. You voluntarily accept these risks.

   Customer Responsibilities

   You agree to follow all instructions from the captain, crew, and guides at every moment. You will disclose any medical conditions, allergies, pregnancy, or physical limitations before the tour begins. You will disclose your swimming ability honestly. You will use safety equipment (life jackets, snorkel gear) as instructed. You will supervise children in your party at all times. You will not dive into unknown or shallow waters. You will care for the equipment, the boat, and the natural environment.

   Drugs and Illegal Substances

   You agree NOT to bring, possess, use, or distribute any illegal substances on any tour, boat, or location operated by Todochido Tours. Violation of this clause results in immediate termination of the tour without refund, and you alone will be liable for any legal, civil, or criminal consequences. Todochido Tours assumes no responsibility for substances you bring or use on your own.

4. 4

   Alcohol

   Alcohol may be consumed responsibly during applicable tours. The captain reserves the right to refuse boarding, cut the tour short, or remove guests showing intoxication that endangers themselves, other guests, the crew, or the operation. No refunds will be issued in such cases.

5. 5

   What Todochido Tours Is NOT Liable For

   Todochido Tours, its captains, guides, crew, partners, owners, and affiliated companies are NOT responsible for: (a) injuries, illnesses, or losses arising from your failure to follow instructions; (b) injuries or losses arising from your intoxication, drug use, or reckless behavior; (c) pre-existing medical conditions, allergies, or limitations you did not disclose; (d) loss, theft, or damage of personal property (phones, cameras, jewelry, clothing, cash, documents) during the tour; (e) weather-related delays, schedule changes, or cancellations; (f) acts of third parties outside our reasonable control (other boats, sea conditions, marine wildlife); (g) damages caused by other guests in your party.

6. 6

   Damages

   You agree to be financially responsible for any damage to the boat, equipment, or property caused by you, members of your group, or anyone you invited. The cost of repair or replacement will be charged according to current market value, payable on the same day or upon written notice from the company.

7. 7

   Photo & Video Release

   Photos or video may be taken during the tour. Mark the checkbox below to authorize Todochido Tours to use this content for marketing purposes (social media, website, brochures). If you do not mark the box, your image will not be used.

8. 8

   Jurisdiction

   This agreement is governed by the laws of Mexico. Any dispute will be resolved in the competent courts of Puerto Vallarta, Jalisco, Mexico.

9. 9

   Acknowledgment

   By signing below, you confirm that you (a) have read and understood this waiver completely, (b) are at least 18 years of age or have a parent/legal guardian signing for any minor in your party, (c) are entering this agreement voluntarily and without coercion, (d) accept all terms and risks described above.
